  5. Your previous bookings including the Roamer appointed, your feedback regarding the tour, Roamer, etc., Product/services, history and pricing details, the date of booking, transaction information, payment history etc.

Cookies: Cookies is a piece of data stored by a website within a browser which enable the browser to remember information specific to a given user such as clicking particular buttons, logging in, or having read certain pages on our site. All leading Internet companies such as Amazon, Yahoo, Google and Facebook use cookies. You can set your browser to notify you when you are sent a cookie, and you can decide whether or not to accept it. 

  7. Your session log information on our site which includes your navigation within the site, source of traffic, IP address (from which we can approximately determine user location), browser type, browser language, operating system, date and time of request etc.

  6. Qro.co.in or any of Qro.co.in’s entities, officers, directors, contracts or agents or any third party shall not be responsible or liable for any criminal activity that you alone or with the Roamer may be involved in at the time of rendering services of anytime thereafter.

4. HOW DOES QRO.CO.IN UTILISE USER OR CUSTOMER INFORMATION?

We only collect user or customer information as required to conduct our business and to enable us to provide the best services to our users and customers. We do not sell or rent this information to third parties. 

 

By user or customer information or personal information, as used above, we mean:

9. JURISDICTION

4. OPERATIONAL PROTOCOLS FOR APPLICANTS (ROAMER/EXPLORER)

 

  1. Registration of Roamers

    1. To register an account, you will be required to provide the registration information along with documents such as aadhaar card and/ or voter ID and/ or driving license and/ or student id along with any other document/s as may be required by qro.co.in (hereinafter referred to as “Registration Data”).

    2. The Registration Data provided by You must be true to the best of your knowledge, information and belief. We will bear no liability for false or incorrect Registration Data provided by you. Please ensure that your Registered E-mail ID and Registered Phone Number are in working order in order to receive communication from Qro.co.in. 

    3. Qro.co.in will be verifying the Registration Data provided by you and subsequently upon successful verification by Qro.co.in. Qro.co.in may at it sole discretion take your interview through any of the mediums (including but not limited to Webcam). Thereafter, on the sole discretion of Qro.co.in you may be shortlisted and become a Registered Roamer with Qro.co.in. We may send an automated e-mail to Your Registered E-mail ID containing a link, which You must click on for activation of Your Account. We may also send upon you the One Time Password on your registered email and/ or registered Phone Number and after verifying your details you shall be active on our website. We may send a Roamers Handbook which will contain the necessary instructions for the Roamers, which the Roamers have to read and follow.

    4. You hereby expressly consent to receive communications from Qro.co.in through your Registered E-mail ID and/or Registered Phone Number.

    5. Notwithstanding anything herein above, Qro.co.in may at its sole discretion allow or disallow any of the Registration by the Roamer and it not obligated to provide any reasons for the same. It is further made clear that Qro.co.in is liberty to terminate and/or suspend your registration at its sole discretion. 

  2. Explorers

    1. To use the services of Qro.co.in you will be required to provide the following information such as Your contact details such as customer name, email address, phone number, residential address, or any other information as may be provided on Qro.co.in etc.

    2. The Registration Data provided by You must be true to the best of your knowledge, information and belief. We will bear no liability for false or incorrect Registration Data provided by you. Please ensure that your Registered E-mail ID and Registered Phone Number are in working order in order to receive communication from Qro.co.in.

    3. Notwithstanding anything herein above, it is made clear that Qro.co.in is liberty to terminate and/or suspend the services being provided to you at its sole discretion.

  3. By registering/ availing the services of Qro.co.in, you agree to the following:

    1. to receive communication, queries and documents from Us;

    2. to provide information/documents that we may require for the purposes of rendering services.

  4. You agree to undertake due diligence, update yourself and comply with all applicable laws that may have implications on your liability as a user;

  5. You need not register with Qro.co.in to simply visit and view this website, but to access and participate in certain features of the Website, you will need to create a password-protected account ("Account") or provide certain information as may be sought by Qro.co.in. You may also have the ability to provide additional optional information, which is not required to register for an account but may be helpful to Qro.co.in in providing you with a more customized experience when using the Website.

You are solely responsible for safeguarding your Qro.co.in password and, if applicable, your Third-Party Site Password (collectively, "Passwords") at all times and shall keep your Passwords secure at all times. You hereby expressly acknowledge and agree that you yourself and not Qro.co.in will be liable for your losses, damages etc. (whether direct or indirect) caused by an unauthorised use of your Account. Notwithstanding the foregoing, you may be liable for the losses of Qro.co.in or others due to such unauthorized use.

5. PAYMENT

  • For each booking the explorer is liable to pay Qro.co.in in accordance with the details provided on the website of the Qro.co.in at www.qro.co.in/book-a-roam, at the time of booking.  

  • The advance amount as prescribed at www.qro.co.in/book-a-roam shall be made to Qro.co.in through Razorpay Payment Gateway. It is agreed that the payment with respect to the first hour of the booking shall be paid to Qro.co.in directly, the payments for the subsequent time period shall be made to the Roamer directly.  The amount payable to the Roamer shall be paid by the Explorer directly to the Roamer and qro.co.in shall have no role/ liability towards the payments made by the Explorer to the Roamer.  

6. CANCELLATION POLICY

  • Notwithstanding anything contained in this Agreement, the booking made by Explorer shall be non refundable and absolutely no amount shall be refunded to the Explorer in case of any cancellation by the Explorer. However, if the Roamer cancels the booking and qro.co.in is unable to arrange for a substitute Roamer, then Qro.co.in shall refund the amount to the Explorer. 

7. ACCOUNTS

  1. Qro.co.in shall prepare a customized plan/trip for rendering the services you have booked based upon the information updated by you with respect to your preferences and choices in food, cuisine, history, culture, arts and any other information provided by you to Qro.co.in.

  2. In case the plan/trip so prepared by the Roamer based upon the Explorer choices does not meet the Explorers satisfaction, Qro.co.in shall not be held liable/ responsible for the same.

  3. Qro.co.in shall supply a detailed statement reflecting the activity for your Account(s) by on-line access (or otherwise if We agree). We will not be responsible for any error that you do not bring to our attention within 90 days from the date of such statement.

8. MARKETING

 

  • Qro.co.in and its business partners may communicate with regard to services, promotions, and other services that may be of interest to users. This may include email or other communications. Qro.co.in may also solicit any User Content provided by the Users of the Website. 

9. USER CONTENT

 

  1. Qro.co.in allows you to post content, including, but not limited to, photos, reviews, ideas, suggestions, links, and other materials. Anything that you post or otherwise make available on or in connection with the Site is referred to as “User Content.” User Content is non-confidential, non-proprietary, and may be used by Qro.co.in, its vendors, or their affiliates for any purpose without further permission, consent, payment, or other consideration, unless prohibited by law. You agree that as a condition of permitting you to submit User Content, you grant Qro.co.in, its affiliates, and any sub-licensees, subject to the Privacy Policy, a non-exclusive, irrevocable, royalty-free, worldwide, fully sub-licensable, perpetual right and license to use, copy, publicly perform, digitally perform, publicly display, and distribute User Content, including the use of your name, alias, and any other information (provided by you), and to prepare derivative works based on, or incorporate into other works, User Content, with or without attribution. You represent and warrant that any User Content is in compliance with all applicable laws and regulations, and it is not composed of and does not contain viruses, solicitations, or any form of spam. Your submission of User Content constitutes an agreement that you will defend, indemnify, and hold Qro.co.in harmless for all claims resulting from User Content you supply.

  2. Qro.co.inis not responsible for, and does not endorse the opinions, advice or recommendations in User Content and specifically disclaim all liability in connection therewith.

  3. Qro.co.in reserves the right to modify, review, delete and refuse to post User Content for any reason.

11. REPRESENTATIONS AND WARRANTIES

  • Each Party represents and warrants to the other that: (a) it has the power and authority to enter into the Agreement and perform its obligations under these Terms of use; (b) it is duly qualified to do business in India; (c) these Terms of Use reflect its legal, valid and binding obligation, enforceable against it; and (d) it shall comply with all Laws applicable to its obligations under these Terms of Use. 

  • Notwithstanding herein above, the Explorers agree that the Roamers are not the employees of Qro.co.in and that Qro.co.in assume no responsibility/ liability for any of their acts which are not in confirmation with law or the present Terms of Use. 

12. CONFIDENTIALITY

  • We will not sell, share or rent your personal information to any third party or use your e-mail address for unsolicited mails. Any emails sent by Qro.co.in will only be in connection with the provision of agreed services.

  • User Account, Password and Security: The user is provided with a password and account designation upon completing the Website’s registration process. You are responsible for all activities that occur under your password or account. You agree to (a) immediately notify at contact@qro.co.in of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Qro.co.in will not be liable for any loss or damage arising from failure to comply with this provision.

13. NOTICES AND PROCEDURES FOR ADDRESSING INTELLECTUAL PROPERTY CONCERNS

All Your communication with Us will be of a professional nature only. You will not contact Us to harass, intimidate or threaten any person, or to promote any cause which You may espouse.

15. SEVERABILITY

 

  • If any part of these Terms of Use is determined to be invalid or unenforceable pursuant to applicable laws then the invalid or unenforceable provisions will be deemed superseded by a valid, enforceable provision that most closely resembles the intent of the original provision and the remainder of these Terms of Use will continue in effect.

16. FORCE MAJEURE

 

  • Neither Party shall be liable for any default or delay in the performance of its obligations under these Terms of Use due to acts of God, terrorism, natural disasters, earthquakes, fire, riots, floods, and other similar events, to the extent such event is beyond the reasonable control of such Party and only for the duration of such event

17. INDEMNITY

 

  • You agree to indemnify Qro.co.in, its partners, respective affiliates, officers, directors, employees, agents, and sponsoring banks from any losses, liabilities, and damages of any and every kind (including, without limitation, our costs, expenses and reasonable attorneys' fees) arising out of any claim, complaint, or chargeback (i) made or claimed by a User with respect to any transaction or transaction data submitted by you, (ii) caused by your noncompliance with these Terms of Use, or the applicable law, including any breach of a representation or warranty made by you. The indemnification provided for in this clause does not apply to any claim or complaint to the extent it is caused by our own negligence or willful misconduct. The indemnity provided herein shall survive even upon deregistration

18. TERM AND TERMINATION

 

  1. Qro.co.in shall have sole discretion to decide the validity of these Terms of Use which shall be provided therein. These Terms of Use shall be effective from the completion of registration process as provided for hereinabove. These Terms will remain in effect until termination as per the procedure laid down below. You shall however continue to be bound by these Terms of Use for the orders/transactions already concluded on the Website. 

  2. You agree that Qro.co.in, in its sole discretion, for any or no reason, and without penalty, may suspend or terminate Your Account or Your terms of the Services and remove and discard all or any part of your account, your profile, at any time. Qro.co.in may also in its sole discretion and at any time discontinue providing access to the Services, or any part thereof, with or without notice. You agree that any termination of your access to the services or any account you may have or portion thereof may be affected without prior notice, and you agree that Qro.co.in will not be liable to you or any third party for any such termination. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies: Qro.co.in may have at law or in equity. Upon termination for any reason, you agree to immediately stop using the Services.

19. DISPUTE RESOLUTION

 

  • These Terms of Use will be governed by and be construed in accordance with the laws of India. All claims, differences and disputes arising under or in connection with or in relation hereto the Website, these Terms of Use, the Agreement(s) or any bookings entered into on or through the Website or the relationship between You and Qro.co.inshall be subject to the exclusive jurisdiction of the Courts in Delhi, irrespective of whether any other Court may have concurrent jurisdiction in the matter. Each party hereby irrevocably waives any objection which such party may now or hereafter have to the laying of improper venue or forum non convenience. Each party agrees that a judgment in any such action or proceeding may be enforced in other jurisdictions by suit on the judgment or in any manner provided by law. These Terms of Use will be governed by and construed in accordance with the laws of India without reference to conflict of law provisions.

20. CHANGE IN TERMS

 

  • These Terms of Use are subject to change without notice. It is urged that You regularly check for changes made to the same from time to time. It is your responsibility to review the Terms of Use for any changes and you are encouraged to check the Terms of Use frequently. Your use of the Website following any amendment of the Terms of Use will signify your assent to and acceptance of any revised Terms of Use. If you do not agree to abide by these or any future Terms of Use, please do not use or access the Website. However, an up-to-date version of the Terms of use shall be available for your review on Qro.co.in at all times.

21. GENERAL INFORMATION

 

  • The Terms of Use, together with the Privacy Policy and any other legal notices or Additional Policies published by Qro.co.in on the Website, shall constitute the entire agreement between you and Qro.co.in concerning the Website. If any provision of the Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms of Use, which shall remain in full force and effect.

  • No waiver of any provision of this these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and its failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

  • You agree that any cause of action arising out of or related to the Website must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred

10. LIMITATIONS OF LIABILITIES

 

  1. Please note that after the Explorer shall be liable for all the expenses towards the trip schedule and Qro.co.in does not assume any liability whatsoever for the same. 

  2. All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. We reserve the right to change any schedule in the interest of the explorer’s safety, comfort & general well-being.

  3. We shall not be responsible for any delays & alterations in the Programme or expenses incurred – directly or indirectly – due to natural hazards, accident, breakdown of machinery or equipment, breakdown of transport, weather, sickness, landslides, political closures or any untoward incidents.

  4. We shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting – directly or indirectly – from any act of GOD, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control.

  5. We do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Explorers from different country are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the explorer's risk.

  6. Qro.co.in shall not be responsible or liable in any way whatsoever, in case of any disputes with respect to payment, services rendered, etc. between the Roamer and the Explorer.
